By accessing or using Consistrack, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

1. Service Overview

Consistrack is a web-based application designed to help users create, manage, and track recurring tasks and habits. The Service provides features such as automated daily task lists, progress tracking, reminders, notifications, and analytics to support personal productivity and habit formation.

2. Account Registration & Security

• You must be at least 13 years old to use Consistrack.
• You are responsible for providing accurate and up-to-date information during registration and for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use or security breach.
• Accounts may be created using email/password or supported social login providers (Google, GitHub).

3. Subscriptions, Payments & Refunds

3.1 Available Plans

• Free Trial: New users receive a 14-day free trial when signing up for the monthly plan. No payment method is required during the trial period. You can cancel at any time during the trial without being charged.
• Monthly Subscription: Billed at $7 USD per month. Provides access to all features. Cancel anytime.
• Lifetime Plan: One-time payment of $74 USD. 30-day money-back-guarantee. Grants permanent access to all current and future features with no recurring charges.

3.2 Payment Processing

• All payments are securely processed through Stripe, Inc. We do not store your credit card information on our servers.
• By subscribing or purchasing, you authorize us to charge the applicable fees to your chosen payment method through Stripe.
• Prices are subject to change with 30 days' notice. Existing subscribers will be notified before any price changes take effect.
• You are responsible for all taxes and fees associated with your purchase, including VAT or sales tax where applicable.

3.3 Subscription Management

• Monthly subscriptions automatically renew unless canceled before the next billing date.
• You may cancel your subscription at any time via your account settings or through the Stripe Customer Portal. Upon cancellation, you will retain access to features until the end of your current billing period.
• No partial refunds are provided for unused time in a billing cycle after cancellation.
• If payment fails or your subscription expires, you will lose access to premium features but retain access to your data and basic features.

3.4 Refund Policy

• Monthly Subscriptions: We offer a 14-day free trial for new users. If you are unsatisfied after being charged, you may request a refund within 7 days of your first charge by contacting support.
• Lifetime Plan: Purchases are final and non-refundable after 14 days from the purchase date. Refund requests within the first 14 days will be considered on a case-by-case basis.
• Refunds are processed through Stripe and may take 5-10 business days to appear in your account.
• We reserve the right to refuse refunds in cases of abuse, fraud, or violation of these Terms.

3.5 Account Suspension for Non-Payment

• If a payment fails, we will attempt to charge your payment method up to 3 times. You will receive email notifications for failed payments.
• If payment is not resolved, your account will be downgraded to the free tier, and you will lose access to the application.
• Your data will be preserved, and you can reactivate your subscription at any time by updating your payment information.

4. User Content & Data

• You retain ownership of the content and data you create or upload (e.g., tasks, habits, preferences).
• You are solely responsible for the accuracy, legality, and appropriateness of your content.
• You can manage your tracker data (create/edit/delete) and delete your account and all related data anytime. Deleted data may not be recoverable.
• We reserve the right to remove content that violates these Terms or applicable law.

5. Notifications

• Consistrack may send you email and/or push notifications related to your tasks, reminders, and account activity.
• You can manage your notification preferences in your account settings or device settings.
• By using the Service, you consent to receive essential communications. You may opt in or out of non-essential notifications.

6. Data & Privacy

• We collect, use, and protect your data in accordance with our Privacy Policy.
• Consistrack uses cookies and similar technologies for analytics and to improve the Service. Analytics tracking is only enabled with your consent via our cookie banner.
• We comply with GDPR and other applicable data protection laws. You have the right to access, correct, or delete your personal data.

7. Intellectual Property

• All content, branding, and software related elements are the intellectual property of Consistrack.
• You may not copy, modify, distribute, or use any part of the Service without our express permission.

8. Acceptable Use

• You agree not to use Consistrack for any unlawful, harmful, or abusive purpose.
• Do not attempt to interfere with the Service, access accounts or data of others, or reverse engineer the software.
• We reserve the right to suspend or terminate accounts engaged in prohibited activities.

9. Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or secure. Use of the Service is at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, Consistrack and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data or profits, arising from your use of the Service. Our total liability shall not exceed the amount you paid (if any) for using the Service.

11. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page and, where appropriate, notified to users. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of France, without regard to its conflict of law principles. Any disputes shall be resolved in the courts of France.
